
Arraigo de Segunda Oportunidad: Spain’s New Second Chance Residency
With the latest reform of Spain’s immigration regulations, a new type of residency has been introduced: Arraigo de Segunda Oportunidad, or "Second Chance Residency." This mechanism came into force on May 20, 2025, and offers hope for individuals who have lost their residence permit or failed to renew it within the past two years.
What Is Arraigo de Segunda Oportunidad?
The name speaks for itself: this residency type is intended for people who need a second chance to legally stay in Spain after falling out of legal residency status. It gives an opportunity to reapply for residency, even if your previous permit expired—provided certain conditions are met.
However, not everyone is eligible. You cannot apply for this type of residency if your previous permit was denied or not renewed due to issues related to public safety or criminal activity. For example, if you committed an offense that led to a denial of your renewal, you would not qualify under this mechanism.
Who Is Eligible?
To apply for Arraigo de Segunda Oportunidad, you must meet the following criteria:
- You are currently physically present in Spain
- You do not have the status of an international protection applicant
- You have been living in Spain for at least two years at the time of your application
- You can prove that you have no criminal record in Spain or in any country where you lived during the last five years
This new regulation offers a much-needed path forward for many people who, for one reason or another, slipped out of legal residency but still have strong ties to Spain.
